Question of the Week

I just created a new nonprofit and applied for 501(c)(3) charitable exempt status.  Due to the cutbacks at the Internal Revenue Service, I have heard it might take 9 months to 1 year for the IRS to send me a determination letter. While it will be retroactive to the date applied for, what do I say in my solicitations? Is "Tax-exempt 501(c)(3) determination pending" enough? What's the best practice? I do not want to burden another nonprofit by asking it to be a fiscal sponsor.    Answer

special_offer_tag.jpgState Charitable Solicitation Statutes: Everything You Wanted to Know But Were Afraid to Ask

Are Charities that seek contributions nationally required to register in 38 states and the District of Columbia that require registration before starting to solicit? What about for-profit fundraisers? Are they required to register and file their contracts and other documentation in some states? Since many states are increasing their enforcement efforts to ensure that charities and fundraisers are complying with initial and annual registration requirements, it's important that charities and fundraisers abide by these statutes-especially since noncompliance can result in the imposition of significant fines and penalties.

Whether you are a nonprofit executive, board member, lawyer or accountant, knowing the intricacies of state charitable solicitation registration statutes are relevant to everyone.
